These terms and conditions of sale apply to all orders and requests placed through the website www.badonlinestore.com ("Online Shop"). 

Please read the terms and conditions of sale before placing any order in our Online Shop. When finalizing the order you will be asked to accept these terms and conditions in full and without reservation. This is where we will explain who we are, how to contact us, how we produce and supply our products, what to do if any problems occur.

The brand BAD - Best Acrylic Design is property of Inovacril - Acrylic Concept, Lda, Portuguese company domiciled at Rua Principal à EN 9.2, Pero Negro, 2590-425 Sobral de Monte Agraço - Portugal, NIF 502590289, registered on the Trade Register of Sobral de Monte Agraço under the number 315. USE OF THE ONLINE SHOP

The use of the Online-Shop implies full and unreserved acceptance by the Customer of the Terms and Conditions of Online Sale, as well as the Privacy Policy and Personal Data Protection, which are in force at any given time.

All information provided by the Customer must be true and complete, and the Customer is responsible for updating this information whenever it changes. The Customer will also be responsible for any false, incomplete or inaccurate information or statements provided and for any damages caused to BAD - Best Acrylic Design and/or Inovacril - Acrylic Concept, Lda and/or third parties as a result of this fact.

In case of violation of the rules stated in the above documents, or any other improper use, Inovacril - Acrylic Concept, Lda may, apart from any other legal action, terminate the respective access/right of use of the Online Store.

INTELLECTUAL AND INDUSTRIAL PROPERTY

The texts, works, drawings, images and photographs reproduced or represented in the Online Shop are protected by their respective copyrights, according to the terms foreseen in the applicable legislation. Any reproduction or representation, alteration or use, total or partial, is strictly forbidden without the previous consent of BAD - Best Acrylic Design / Inovacril - Acrylic Concept.
The company names, brands, as well as any other distinctive signs reproduced in the Online Shop are also protected under the terms of the applicable legislation.


ORDERS AND PAYMENTS

The order in the Online Store is final from the moment in which the client confirms it. Our purchasing process allows the client to evaluate and validate his intention to purchase, as well as the specifications and characteristics of the product he wishes to acquire, notwithstanding that all orders are subject to our acceptance. After acceptance of the delivery conditions of the products ordered and confirmation of payment, we will send you a message confirming acceptance of your order.

For us to validate the order, the amount indicated on the payment page of your order must be fully paid. We accept the payment methods indicated in our Online Store

PRICES AND PRODUCT FEATURES

The prices in the Online Shop are indicated in Euros and include VAT at the legal rate in force and are valid, except for manifest and obvious error, applying only to items sold in the Online Shop.

Prices and specifications published in the Online Shop are subject to change without notice.

The items sold are described and presented on the site with the greatest possible accuracy and precision, but this does not mean that inconvenient technical errors or damages inherent to the use of the internet network, such as for example a service interruption, an external intrusion or the presence of computer viruses, or any other unforeseen case of force majeure, may not occur. BAD - Best Acrylic Design will not be held responsible when such events lead to changes in the advertised prices.
During the order processing phase, any price errors that may be appearing on the site due to technical anomalies must be detected. In this situation, and according to the procedures, the customer will be contacted by our services and if the price of the product is higher, he/she may accept or cancel the order that was made.

Unless otherwise stated, all promotional campaigns advertised in the Online Store, have a limited and exclusive stock for online marketing.

CANCELLATIONS

The order in the Online Store is final from the moment the customer confirms, pays and is validated by the company. Our purchasing process allows the customer to evaluate and validate their purchase intention, as well as the specifications and characteristics of the product they wish to purchase. As a customer, you have the right, subject to certain exceptions, to free contract resolution, protected by law, within 14 calendar days from the day following that of your order.

Requests for order cancellations must be made in writing. If the cancellation is confirmed, the delivered amount will be refunded by the same means of payment used at the time of purchase, within a period not exceeding 30 days after the refund conditions are met. DELIVERY TIME AND CONDITIONS

The delivery time for orders placed in the Online Store is indicated on the respective web page for each product. Although we do everything possible to meet the indicated delivery deadline, we cannot guarantee that they may not be affected by events beyond our control, such as, for example, unforeseen difficulties in the supply chains, carrier strikes, health emergency situations, or other unforeseen events not directly depending on our will or availability.

If it is not possible to meet the contracted deadline, our services will contact you to reschedule the delivery. The essence of the business is not the delivery date, so this is not binding.

Delivery of ordered products may be made by an external carrier contracted for this purpose or by our logistics team. 
For the locations for which we guarantee the delivery of products, the delivery cost is automatically indicated at the time of order confirmation. In other cases, the delivery service will be subject to a quotation, which we will inform you of before you make your payment.

The delivery of the products ordered is made at the address indicated by the customer when placing the order, and includes only the transport, therefore without installation of the products sold, and only in Portugal mainland and islands. 

As soon as your order becomes available for delivery you will be contacted by our services in order to check your availability and to schedule the delivery of your products.

PAYMENT METHODS

Payments of orders in the Online Shop can be made by the following methods: 

Visa , Mastercard , Redunicre, Paypal, MB WAY and ATM Reference.

BAD - Best Acrylic Design processes payments through a partner specialized in electronic payments (SIBS and PayPal). BAD - Best Acrylic Design or Inovacril - Acrylic Concept, Lda does not have access to nor keeps, in any moment, the data associated to your payment. We only receive from SIBS or Paypal the simple confirmation of your payment. BAD - Best Acrylic Design Online Shop has SSL certification given to secure e-commerce sites.

BILLING ADDRESS AND DELIVERY ADDRESS

You will be able to choose a different delivery address from the billing address during the purchase process. It is your responsibility to provide the correct billing and delivery details. Unfortunately once your order is completed and ready for delivery we will not be able to change these details.

PHOTOS/IMAGES IN THE ONLINE SHOP

The photographs in the Online Shop are purely illustrative, not exempting a reading of the characteristics and / or details / technical specifications of the product that are described. The photographs are made so that you can visualize each one of our products in the most detailed way possible, therefore the complementary accessories used are not included. However, you may find differences in the products where the raw material itself and its manufacturing process influence the final result. We also draw your attention to the fact that the colours displayed on your screen may not correspond exactly to the final product, as they depend on the computer's own settings.

FINISHES AND COLOURS

You can choose a delivery address that is different from the invoicing address during the purchase process. It is your responsibility to indicate the correct billing and delivery details. Unfortunately once your order is completed and ready for delivery we will not be able to change these details.

CUSTOMIZATION

We produce all the products in the Online Shop. Consequently we can customize any and all of our products. If you wish to customize the materials or measurements of this product, you can do so from the product page indicated. Our team will evaluate your request and will contact you as soon as possible.

Product customisation will have an effect on the price, delivery time and conditions, cancellation and return of the same. The agreed delivery time only starts after acceptance by BAD - Best Acrylic Design.  

CONSUMER RIGHTS AND DISPUTE RESOLUTION

Your rights as a consumer are guaranteed by law. The protection offered by BAD - Best Acrylic Design is, in general terms, that guaranteed by EU DIRECTIVES 2019/771 and 2019/77, in their transposition into the law of each of the member countries of the European Community, being in Portugal Decree-Law No. 84/2021 of 18 October.

In the event of disagreements or conflicts that cannot be resolved amicably and informally, the online European Community Online Dispute Resolution platform will be used, available at the following electronic address: https://ec.europa.eu/consumers/odr.

CUSTOMER REGISTRATION ON THE SITE

To make purchases through the Online Store you should register as a Customer by filling out the form available for that purpose in the Customer Area. After registering, you just need to insert in your shopping cart the products to buy, following then all the steps that are being indicated. Being registered, you will be able to make your purchases, modify/update your data whenever you need and consult the state of the orders in course or the orders made previously.

RETURNS POLICY

We strive to ensure the full satisfaction of our customers. We produce all items in our factory, upon finalized and validated order, and take all measures to ensure that the product is designed to high standards. This means that, with some exceptions, we do not work with stocks, i.e. the product you order will be produced on purpose for you. Nevertheless, we know that occasionally situations may occur that lead our customers to wish to reverse their purchase decision. Thus:

GUARANTEES

All items sold by BAD - Best Acrylic Design are guaranteed against production defects for a period of three years, safeguarding that their use during this period is within the normal conditions of use for which they were developed and manufactured.
 
During this guarantee period, any production defect that appears gives the client the right to obtain
- The repair of the defect
- Replacement of the item
 
All our articles are produced and finished by hand, thus guaranteeing the unique and distinctive characteristics of each piece.

RIGHT TO CANCEL

The order in the Online Shop is final from the moment in which the customer confirms, pays for and validates it with the company.Our purchasing process allows the customer to evaluate and validate his purchase intention, as well as the specifications and characteristics of the product he intends to purchase. Nevertheless, as a customer, you have the right, subject to exceptions, to free cancellation of the contract protected by law within 14 calendar days from the day following that of your order. The Right to Cancel does not apply to customised products or products made to order by customers who cannot be classified as End Customers.
The list of recognised exceptions which entail the non-application of the Right to Cancel are defined by law.
 
Requests for order cancellation must be made in writing using the form that can be downloaded here and that, once completed and signed, must be sent electronically to the following e-mail address: comercial@badonlinestore.com or by post to the address indicated in the Terms and Conditions of Sale of the Online Store. 

If the Right of Cancellation is confirmed, the amount paid in the meantime will be refunded by the same means of payment used at the time of purchase, within a period not exceeding 30 days after the Refund Conditions have been met. 


EXCHANGES AND REFUNDS

BAD - Best Acrylic Design is not obliged by law to exchange or refund the value of orders after confirmation by the client, except in cases where the items purchased cannot perform the function for which they were developed, or they do not meet the requirements and specifications advertised. However, in the event of any article not being able to perform the function for which it was developed, BAD - Best Acrylic Design may, on its own initiative, allow its exchange, accept its exchange for another article or issue credit notes on the sales documents.  

RETURNING ARTICLES

We inspect all the items we manufacture with the utmost care and attention before packing and shipping to our customers. However, it may be possible that during the packing and shipping process, or during the transport and handling of the item, situations may occur that cause damage or incomplete deliveries. In this case, if you receive damaged items or incomplete or wrong orders, you should proceed as follows:
 
- DAMAGED ARTICLES - Upon receipt, inspect the packaging for any external markings that may indicate damage to the item. If the item is transported by us, or by a carrier contracted by us, the customer should contact our services at: comercial@badonlinestore.com and we will proceed with its repair or in exceptional cases its replacement.  

- INCOMPLETE OR DEFECTIVE ITEMS - As much as we try to avoid it, in some situations the customer may receive an incomplete or defective item. If this happens, you should contact our services through the contacts indicated in the Terms and Conditions of Sale of the Online Store, presenting your case and sending all the documents you can gather to verify and confirm the defect or lack so that we can provide the repair and/or replacement/replacement.


RETURN

Items returned under the Right of Cancellation, Exchange in Guarantee or Return accepted by BAD - Best Acrylic Design must be returned unused, in their original condition and properly packaged, within 14 days of the date of the return request. The costs and risks inherent in the transport for return are the responsibility of the client. 

REFUND CONDITIONS

In cases in which BAD - Best Acrylic Design, by its exclusive will, accepts or is obliged by law to refund the amounts paid at the time of the order placed, the same will be done in a period never exceeding 30 working days, after we verify that the product whose return originated the refund has been received at our facilities and we confirm that it is in the required conditions.
The return is made through the same method of payment used in the purchase.

CONSUMERS RIGHTS AND DISPUTE RESOLUTION

Your rights as a consumer are guaranteed by law. The protection offered by BAD - Best Acrylic Design is, in general terms, guaranteed by EU Directives 2019/771 and 2019/770, in their transposition into the legal system of each of the members of the European Community.
